Delaware’s telemarketing registration law

On top of the federal TCPA, Delaware’s telemarketing law (6 Del. C. chapter 25A) generally:

  • requires sellers and telemarketing businesses to register with the Department of Justice,
  • requires a $50,000 surety bond, renewed each year,
  • requires stating the sales purpose, the caller’s name, the seller’s name and the product before the pitch,
  • bars calling a customer who asked to stop for 10 years, and
  • gives phone buyers a seven-business-day cancellation right, with notice in the language of the call.

Consumers can sue for damages and attorney fees, and sales by unregistered sellers can be canceled. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

Frequently Asked Questions

Does Delaware require telemarketer registration?

Delaware generally requires sellers and telemarketing businesses to obtain a certificate from the Department of Justice Consumer Protection Unit, pay a fee and post a $50,000 surety bond, renewed each year. Exemptions include Delaware retail stores open at least a year that make most sales at the store, and contacts started by the customer that weren't prompted by a solicitation. This is general information, not legal advice; your dealership's counsel should advise on your situation.

What else does Delaware require?

Before the sales pitch, the caller generally must say that the call is to sell something and give their name, the seller's name and the product. A customer who asks not to be called can't be called again for 10 years, and phone sales generally carry a seven-business-day cancellation right with written notice in the language used on the call.
