Oregon’s telemarketing law

On top of the federal TCPA, Oregon’s telemarketing law (ORS 646.551 and following, as amended by HB 3865) generally:

  • covers calls and texts, effective January 1, 2026,
  • limits solicitations to 8 a.m. to 8 p.m.,
  • caps solicitations at three in 24 hours, unless there’s an established business relationship,
  • designates the National Do Not Call Registry as Oregon’s list, and
  • bans altering caller ID and misrepresenting who’s calling.

Consumers can sue for $200 or actual damages, whichever is greater, and willful violations can bring penalties of up to $25,000. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

House Bill 3865, effective January 1, 2026, added text messages to Oregon's definition of a telephone solicitation, moved the evening cutoff from 9 p.m. to 8 p.m., limited solicitations to three in 24 hours, and banned altering caller ID. Customers with an established business relationship, generally a transaction in the prior 18 months, are exempt from the hours and frequency limits. This is general information, not legal advice; your dealership's counsel should advise on your situation.

Does Oregon require telemarketer registration?

Oregon generally requires telephonic sellers to register with the Department of Justice before calling, with exemptions that include calling prior purchasers and sales completed at a later face-to-face meeting. Consumers can sue for actual damages or $200, whichever is greater, and willful violations can bring civil penalties of up to $25,000.
