What North Dakota dealers get

English & Spanish

Mexican and other Spanish-speaking customers served in Spanish.

Texts are covered

North Dakota's law treats voice, text and other electronic messages alike.

Inquiries don't count

In North Dakota, a past inquiry alone doesn't create an established business relationship; a purchase or transaction does.

North Dakota’s Spanish-speaking car buyers

North Dakota’s Hispanic community has grown with the energy and agriculture economy, in Fargo and West Fargo, Bismarck, Grand Forks, and Williston and Watford City. Call Contact Confirm works every lead and call in English or Spanish, whichever the customer prefers. See bilingual BDC.

North Dakota’s telephone solicitation law

On top of the federal TCPA, North Dakota’s telephone solicitation law (N.D.C.C. chapter 51-28) generally:

  • covers voice, text and other electronic messages,
  • limits sales calls to 8 a.m. to 9 p.m. at the subscriber’s location,
  • requires the caller’s true first and last name, a phone number, city and state, and the business name immediately,
  • counts only a purchase, lease or transaction within 24 months as an established business relationship, and
  • prohibits blocking caller ID and restricts prerecorded messages.

Consumers can sue for $2,000 per violation or actual damages, whichever is greater, plus attorney fees. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

Sales calls are limited to between 8 a.m. and 9 p.m. at the subscriber's location, and prerecorded messages generally require consent. This is general information, not legal advice; your dealership's counsel should advise on your situation.

Which contacts are exempt in North Dakota?

Contacts with the consumer's prior express written request or consent, and contacts with an established business relationship, meaning a purchase, lease or financial transaction within 24 months, are generally exempt.
