Minnesota’s telephone solicitation law

On top of the federal TCPA, Minnesota’s telephone solicitation law (Minn. Stat. 325E.26 to 325E.31) generally:

  • limits commercial telephone solicitations to 9 a.m. to 9 p.m.,
  • requires consent or a live operator first for prerecorded sales messages,
  • requires live operators to give the business name, purpose and offer before a recording plays,
  • requires disconnecting within 10 seconds after the customer hangs up, and
  • relies on the National Do Not Call Registry (the state list expired in 2010).

Violations can bring Attorney General enforcement, and consumers can sue for damages and attorney fees. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

Frequently Asked Questions

What are Minnesota's calling hours?

Minnesota law generally prohibits commercial telephone solicitations before 9 a.m. or after 9 p.m. Prerecorded or synthesized sales messages generally require the subscriber's consent, or a live operator who states the business, the purpose and what's being offered and gets consent first. This is general information, not legal advice; your dealership's counsel should advise on your situation.

Does Minnesota have its own Do Not Call list?

No. Minnesota's old state no-call law expired in 2010, so the National Do Not Call Registry applies. Violations of Minnesota's telephone solicitation law can bring Attorney General enforcement, and consumers can sue for damages and attorney fees.
