The federal baseline
Every sales call and text in the United States falls under the Telephone Consumer Protection Act (TCPA) and the National Do Not Call Registry. In general terms, federal rules prohibit sales calls before 8 a.m. or after 9 p.m. in the customer’s local time, require honoring do-not-call requests, and require consent for certain automated and prerecorded calls and texts. The states below add their own rules on top.

What this means for dealerships
- Know where your customers live. Out-of-state customers can bring their home state’s rules into play.
- Florida, Oklahoma, Maryland and Oregon limit frequency. Three sales contacts in 24 hours is the cap in those states (on the same subject in Florida, Oklahoma and Maryland).
- Some states ban Sunday calls. Alabama, Louisiana, Mississippi, Rhode Island, South Dakota and Utah bar most sales calls on Sundays.
- Many states require registration. More than 20 states, including Ohio, Pennsylvania, Kentucky, Mississippi, Delaware and West Virginia, have registration or bond rules for telephone solicitors, with various exemptions.
- Identification rules are specific. Virginia requires a first and last name; New Jersey requires a phone number; Washington and New Jersey set 30-second deadlines, Connecticut sets a 10-second one and Alaska a 15-second one.
- Your BDC’s practices affect you. In Virginia, the seller and the calling company are jointly liable for violations.
