Nebraska’s recorded-message calling rules

On top of the federal TCPA, Nebraska’s automatic dialing-announcing device law (Neb. Rev. Stat. 86-236 and following) and Public Service Commission rules generally:

  • require a Public Service Commission permit for each device that plays recorded sales messages,
  • require filing message scripts with the Commission,
  • limit recorded-message calls to 8 a.m. to 9 p.m., and 1 p.m. to 9 p.m. on Sundays and legal holidays,
  • require the message to identify the caller and give a callback number, and
  • require keeping an internal do-not-call list with a written policy.

Violations can bring Public Service Commission fines and criminal penalties, and the Commission can seize devices. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

Frequently Asked Questions

Do Nebraska's rules apply to live calls?

Nebraska's automatic dialing-announcing device law applies to automated calls that play a recorded message. Live-agent calls without a recording, calls the person invited or permitted, and calls to people with an existing business relationship are outside that law, so federal rules generally govern those calls. This is general information, not legal advice; your dealership's counsel should advise on your situation.

What does Nebraska require for recorded-message calls?

In general terms, each device needs a Public Service Commission permit, good for two years, and scripts must be filed with the Commission. Calls are limited to 8 a.m. to 9 p.m., Monday through Saturday, and 1 p.m. to 9 p.m. on Sundays and legal holidays. Messages must identify the caller, give a callback number and run no longer than two minutes.
