Indiana’s telephone solicitation law

On top of the federal TCPA, Indiana’s telephone solicitation law (Indiana Code 24-4.7) generally:

  • sets up a state Do Not Call list kept by the Attorney General, updated quarterly,
  • counts text, picture and app messages as telephone sales calls (2024 amendment),
  • requires the caller’s real first and last name and the business the call is made for, given immediately,
  • requires consent, or a live operator first, before an automated dialing and announcing device plays a message, and
  • prohibits blocking caller ID.

The Attorney General can seek up to $10,000 for a first violation and $25,000 for each later one. Our team honors opt-outs immediately and respects your CRM’s do-not-contact flags. This is general information, not legal advice. Your dealership’s attorney should review your consent forms and outreach policies.

Frequently Asked Questions

Does Indiana have its own Do Not Call list?

Yes. The Indiana Attorney General keeps a state Do Not Call list covering home, wireless and internet phone numbers, with new listings released in January, April, July and October. Indiana law generally prohibits sales calls and texts to numbers on the most current quarterly listing, with exceptions such as calls made at the consumer's express request. Unlike federal rules, Indiana has no general exception for existing customers. This is general information, not legal advice; your dealership's counsel should advise on your situation.

What does Indiana require at the start of a sales call?

Indiana generally requires the caller to give, right away, their real first and last name and the name of the business the call is made for. Violations can bring civil penalties of up to $10,000 for a first violation and up to $25,000 for each later one, and each call counts separately.
